Terms of Service Starting from May 11, 2023

General

Pörssäri is an electronic service maintained by Tuomas Kiviluoto and Atte Myllylä (hereinafter referred to as the "Service"). The maintainers are referred to in this document as the "Service Provider."

Pörssäri is intended primarily for the use of private individuals (hereinafter referred to as the "User").

Pörssäri is primarily a settings portal where the defined settings are transmitted to the User's electrical devices using Shelly relays or other programmable microcontrollers (e.g., Raspberry Pico W). The use of the Service is only permitted with devices approved by the Service Provider (hereinafter referred to as the "Devices"). A list of approved devices can be obtained from the Service Provider and may also be provided on this website.

Using the Pörssäri service requires that the registered user of the service accepts and agrees to comply with the terms listed in this document. The User must carefully read these terms before starting to use the Service. The User must accept the Terms of Service to use the Service.

The use of the Service is permanently free for the User.

Purpose of the Service and User's Role

The Service is intended for the control of the User's electrically powered heating or other devices based on a control algorithm provided by Nord Pool's Spot price interface and/or weather forecast. The control is transmitted using the Devices connected to the Service.

The Service is intended for the management of the User's Devices to the extent possible within the framework of the Service. The Service Provider has the exclusive right to decide the extent and content of the Service offered to the User. Through the Service, the User can, for example, set time-based controls, weather forecast-based controls, and electricity price-based controls for the Devices.

The User is obliged to use the Service in accordance with these terms of use, the EU General Data Protection Regulation, national legislation, official regulations, and good practice. The User is fully responsible for any damage caused intentionally or negligently to the Service Provider and third parties due to the use of the Service contrary to the terms of use, law, official regulations, or good practice. The Service Provider has the right to prevent the use of the Service if there is reasonable suspicion that the Service is being used contrary to good practice and the law.

The Service must not be used to publish or distribute copyrighted or similarly protected material without the permission of the rights holder, or in a way that is harmful, offensive, or damaging to the Service Provider or third parties.

Right of Use

The User does not receive any rights other than the right to use the Service according to these terms of use.

Registration and Use of the Service

Only a natural person can register as a User of the Service. The Service is personal and must not be transferred to third parties. When registering as a User of the Service and whenever logging into the Service, the User is responsible for the accuracy and timeliness of the information provided. The User can maintain their mobile phone number and email address in the Service. This information may be used as means of electronic communication, such as sending notifications ("alert messages") by email or text message.

Using the Service requires the User to accept and comply with the Terms of Use and any additional terms specific to the service. The Service may only be used for private, non-commercial purposes. The User may not otherwise exploit the Service or its parts without the written permission of the Service Provider. The Service Provider reserves the right to deny the Service to the User.

The User can save information related to the property they own, such as the square footage, building material, and location coordinates, in addition to their contact details in the service. The information saved by the User is available to the Service Provider and can be used anonymously for the development of the service.

The use of the Service is free or paid for the User according to the terms and conditions in effect at the time. If the Service Provider makes some functionalities of the Service paid, the change will only apply to users who register after the change.

Copyright

The content and design of the Service are protected by copyright. All usage rights, copyrights, and other intellectual property rights of the Service belong to the Service Provider.

Copying, printing, distributing, transmitting, modifying, linking to other websites, and any other commercial exploitation or making the material available to the public without the written permission of the Service Provider is prohibited. However, the User may print and save material available from the Service for their private use.

When using the Service within the scope permitted by the Agreement, the name of the Service Provider must always be mentioned.

Services Contained in the Service Provided by Partners

The Service may contain and be accessible through content and services provided by Partners and/or the User themselves, for which each Partner and/or User is responsible. The Service Provider is not responsible for the content or services provided and published by Partners or the User found in or linked from the Service.

The use of the services provided by Partners requires acceptance of these terms of use when taking the Service into use. If the User cancels the use of the Service, the possibility to use the services of the Partners may also be canceled. The User's personal and contact information may be transferred from the Service to the services of the Partners if it is necessary to use the services of the Partners. Personal and contact information may also be transferred from the services of the Partners to the Service to ensure the consistency of the contact information.

Responsibilities and Obligations

User's Responsibilities and Obligations

The User is responsible for having a working internet connection and sufficient technical capabilities and software for using the Service. The User is also responsible for the security and functionality of the devices and software they use and for all costs arising from the use of the Service. The User is responsible for the accuracy of the mobile phone number and email address provided to the Service.

The User is obliged to keep their identification information confidential. The User is responsible for all use of the Service with their identification information and for any costs, fees, obligations, and consequences that may arise.

The User is responsible for ensuring that the Devices added to the Service are installed in accordance with the applicable electrical installation legislation. The User is responsible for the correct operation and maintenance of the Devices. The User is responsible for ensuring that the Devices are installed in such a way that no harm is caused to the User's devices or property if the Service is out of operation due to a technical fault or other reason.

The Devices connected to the Service by the User must be installed in property owned or controlled by the User.

Service Provider's Responsibilities and Obligations

The accuracy, precision, reliability, and usability of the information presented in the Service have been carefully ensured before publication, and the accuracy and functionality of the information contained in the Service are regularly checked.

The Service Provider does not guarantee the uninterrupted and error-free operation of the Service. The Service is regularly checked to prevent malfunctions. The Service Provider has the right to suspend the operation of the Service for changes, renewals, maintenance and installation work, or other similar reasons related to the Service, or if required by legislation or other official regulations. However, efforts will be made to inform Users of interruptions as early as possible through a general announcement on the service's front page.

The Service Provider is not responsible for any material or technical errors or deficiencies in the Service or for any direct or indirect damages caused by the use or interpretation of the information contained in the Service, whether these errors are due to errors, malfunctions in the Service or telecommunications connections, maintenance work, or other reasons.

The Service Provider is not responsible for any damage caused to the User's Devices or the electrical devices they control.

The Service Provider will make the best possible effort to preserve the control settings made by the User. However, the Service Provider is not responsible for the loss of settings and any resulting malfunctions of the Devices.

The Service Provider has the right to change the content, functionality, and accessibility of the Service without restriction in a way and at times deemed best for the development of the service or for other necessary reasons.

Use of Personal Data

The Service Provider stores the personal data provided by the User (such as name, address, and phone number) and other identification data related to the User's use of the Service in a personal register, as defined in the privacy statement. This data may be used for the planning and development of the Service Provider's operations and the development of the Service. The Service Provider does not disclose the information collected about the User to outsiders without a legal basis.

When processing the personal data of Users, the Service Provider complies with the applicable data protection legislation, such as the EU General Data Protection Regulation (GDPR 2016/678) and the Data Protection Act (1050/2018), as well as good data processing practices.

Information Security

The User is aware that the online environment and online services are not entirely secure. The User is responsible for ensuring the information security of their own information systems appropriately. The Service Provider organizes the information security of the Service in a generally accepted and efficient manner and strives to prevent unauthorized access to its information systems with appropriate technical solutions.

Change of Terms of Use

The Service Provider has the right to unilaterally change these terms of use at any time at its discretion. The change will take effect from the date specified by the Service Provider. If the User does not accept the changed terms of use, they may refuse to accept them by stopping the use of the Service.
